The Elkin Hills Neighborhood has been designated by the Town Council as a Neighborhood Conservation District zoning overlay.

The Elkin Hills Neighborhood was the tenth neighborhood in Chapel Hill to become a Neighborhood Conservation District; therefore, it is referenced as CD-10.

 

What is a Neighborhood Conservation District Zoning Overlay?

Neighborhood Conservation District (NCD) Zoning Overlay is a set of land use regulations that is applied to a specific neighborhood as a zoning overlay. Any new construction or additions must comply with the Neighborhood Conservation District regulations.

Elkin Hills Neighborhood Conservation District Plan

The Town Council amended the Zoning Atlas to include the Elkin HillsNeighborhood Conservation District zoning overlay.

The Elkin Hills Neighborhood Conservation District Plan is comprised of two parts: CD-10A and CD-10B. Different regulations were developed for different sections of the neighborhood to better represent and regulate the varying characters of the different sections.

The Elkin Hills Neighborhood Conservation District Plan outlines the regulations for the neighborhood. Any new construction or additions must comply with these regulations.

Overview of Elkin Hills Process 

  • Phase One Petition Submittal: On March 12, 2012, the Town Council accepted the petition from the Elkin Hills residents to begin Phase One of the Neighborhood Conservation District (NCD) Zoning Overlay which is an informational phase.
  • Phase Two Petition Submittal: In September of 2014, the Elkin Hills neighborhood submitted a petition to initiate Phase Two of the Neighborhood Conservation District process. The neighborhood met the threshold to initiate Phase Two (signatures were received by 51% of the homeowners). 
  • Planning Commission Feasibility Review: On April 7, 2015, the Elkin Hills petition was reviewed by the Planning Commission. Click here for the staff memorandum. The Planning Commission voted four (4) in favor with three (3) opposed to the following recommendation: To recommend that staff move forward with the Elkin Hills process. The motion also included two friendly amendments: A) That prior to approving an NCD, the Council consider how many property owners support the NCD; and B) That the neighborhood submit a second petition with property owner signatures at the end of Phase Two. Click here for the Planning Commission action minutes.     
  • Council Consideration to begin process: On October 14, 2015, the Council passed a resolution to begin the process to develop a Neighborhood Conservation District Plan (overlay zoning regulations) for the Elkin Hills neighborhood. Click here for the staff memorandumClick here for a video of the meeting - Under Item #9. See below for information about next steps.

Next Step - Developing the draft regulations

On October 14, 2015, the Council passed a resolution to begin the process to develop a Neighborhood Conservation District Plan (overlay zoning regulations) for the Elkin Hills neighborhood. The next step in the process was for the neighborhood residents, Town staff, and Planning Commission liaisons to work together to draft the Neighborhood Conservation District regulations. The current regulations can be found here. These were then reviewed by the Planning Commission who provided a recommendation to the Council for their consideration of adoption.
