Status Update: The Council has referred this topic to the Historic District Commission and Planning Commission for possible additional consideration.

Possible updates to the land development regulations include rules pertaining to Bed & Breakfast establishments. These updates will focus on the question of where and how to permit bed and breakfast establishments in the Town's residential zoning districts. Specific areas for possible change include:

  • An opt-in process for neighborhoods to determine whether they want to allow bed and breakfasts 
  • No more than 4 guest rooms permitted with Site Plan approval by the Planning Commission
  • Up to 12 guest rooms allowed with approval of a Special Use Permit by the Planning Commission
  • Required on-site parking for guests, the owner and any employees
  • Requirement for a renewable Town zoning compliance permit, every two years

Excerpt from page 54 of the Critique & Technical Report:

On January 11, 2011, the Council received a petition from residents requesting the Council to amend the LUMO to allow bed and breakfast establishments as a use allowed by-right in the residential zoning districts. The Town is considering allowing bed and breakfast establishments by-right in certain residential districts. Generally, these types of activities in residential districts are innocuous and near town centers make a lot of sense. Some communities have found it beneficial to have a separate (non-LUMO) licensing ordinance for innkeepers and hotels. As the Town goes through its updated planning process and re-thinks the LUMO, they should consider other types of uses that might help to stabilize residential neighborhoods.The Town is considering allowing bed and breakfast establishments by-right in certain residential districts.
