The Town of Chapel Hill Code of Ordinances' section on Soil Erosion and Sedimentation Control (Chapter 5, Article V) was enacted to address soil erosion and sedimentation control and prevent degradation of area waterways. This ordinance and its enforcement contributes to meeting the Town's NPDES minimum requirements for Construction Site Stormwater Runoff Control. Enforcement of erosion prevention in the Town is handled by Orange County Erosion Control.
All projects which disturb more than 20,000 SF within the Town of Chapel Hill and its Extraterritorial Jurisdiction (ETJ) must have an approved Erosion and Sedimentation Control Plan and Permit from NC DEQ or Orange County Planning and Inspections. Residential single family homes, and projects that disturb less than 20,000 SF, are still required to provide erosion control measures. At a minimum these measures should include a construction entrance and silt fencing along downhill slopes of the site. The Town reserves the right to request additional erosion and sediment control measures if the proposed measures do not contain the sediment on site. Sediment leaving the property is a violation of the Town’s Erosion and Sediment Control Ordinance.
